1. SCOPE OF APPLICATION

1.1 These General Terms and Conditions (GTC) apply to all deliveries from KussatzTrade to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity.

1.2 Deviating or conflicting conditions of the customer shall not apply.

1.3 If business days are specified as deadlines, this includes all weekdays except Saturdays, Sundays, and public holidays.

2. STORAGE OF THE CONTRACT TEXT AND GTC

2.1 We store the contract text and send you the order details via email. If you have created a customer account, you can view your orders there. Without a customer account, the contract data will no longer be available online for security reasons.

2.2 These General Terms and Conditions are available at any time on our website and can be saved or printed using the functions of your internet browser.

3. CONCLUSION OF CONTRACT / RESERVATION OF DELIVERY

3.1 The presentation of products in our online shop does not constitute a legally binding offer, but rather an non-binding online catalog. By clicking the "Buy Now" button, you place a binding order for the goods in the shopping cart. After submitting the order, you will receive a confirmation of receipt of your order via email. This confirmation does not constitute acceptance of your offer. The purchase contract is only concluded upon shipment of the goods.

3.2 If a product is unavailable and we are not supplied in a timely manner, we reserve the right to withdraw from the purchase contract. In this case, we will inform you immediately and refund any payments already made.

4. PAYMENT / PRICES

4.1 The available payment methods are listed on the "Payment" page. Payments by cash or check are not possible.

4.2 If a payment is reversed without a valid reason, the customer shall bear the costs incurred as a result.

4.3 All prices listed in the online shop are in euros (€) and include the statutory value-added tax. Shipping costs are calculated according to our price list. Any customs duties or import fees outside the EU are to be borne by the buyer.

5. SHIPPING

The current shipping costs can be viewed on the "Shipping & Delivery" page. In case of partial deliveries, the shipping costs are only charged once.

6. TRANSPORT DAMAGES

KussatzTrade assumes the transport risk. If goods arrive damaged, please contact us immediately. This can be done either via email at: support@kussatz-trade.com or alternatively by phone at: +49155 - 60845587.

7. INTERNATIONAL DELIVERIES / CUSTOMS FEES

Customs fees do not apply to shipments within the European Union (EU). For orders outside the EU, import fees may apply, which are to be borne by the customer. Please inform yourself in advance with your responsible customs authority about any potential costs.

8. RETENTION OF TITLE

The goods remain our property until full payment has been made.

9. WARRANTY / DEFECT NOTIFICATION

9.1 The statutory warranty rights apply. KussatzTrade is liable for material defects in accordance with the applicable legal provisions, in particular §§ 434 ff of the German Civil Code (BGB).

9.2 Obvious defects must be reported immediately, but no later than 14 days after receiving the goods.

9.3 KussatzTrade strives for customer satisfaction and will review your complaint as quickly as possible and contact you promptly. If you have contacted KussatzTrade via email and have not received a response within 5 business days, please reach out to us again. Your consumer rights in the event of a defect remain unaffected.

10. RIGHT OF WITHDRAWAL

10.1 If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to your commercial or self-employed professional activity), you have a right of withdrawal in accordance with legal regulations.

10.2 If you exercise your right of withdrawal according to section 10.1 as a consumer, you shall bear the regular costs of returning the goods.

10.3 Otherwise, the regulations stated in detail in the following Withdrawal Policy apply.

Withdrawal Policy​ - Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without stating any reason.

The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (KussatzTrade, Zwieseler Str. 42a, 10318 Berlin, +49 155 60845521, support@kussatz-trade.com) by means of a clear statement (e.g., a letter sent by post or an email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

You can also electronically complete and submit the sample withdrawal form or another clear statement on our website (insert website address). If you use this option, we will immediately (e.g., via email) send you a confirmation of receipt of such a withdrawal.

To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs arising if you have chosen a different type of delivery than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day we received your withdrawal notice.

For this repayment, we will use the same means of payment that you used in the original transaction unless explicitly agreed otherwise with you; in no case will you be charged fees for this refund.

We may withhold the refund until we have received the returned goods or until you have provided proof that you have sent back the goods, whichever is earlier.

You must return or hand over the goods to us or to (if applicable, insert the name and address of the authorized recipient) without undue delay and, in any case, no later than fourteen days from the day you informed us about the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling that is not necessary for checking the nature, characteristics, and functionality of the goods.

11. USAGE RIGHTS

11.1 The website of the online shop www.kussatz-trade.com, as well as the sub-pages listed under it and the logos displayed therein, are protected by copyright. The images contained therein are likely protected under § 2 (5) UrhG (Copyright Act) as photographic works or works created similarly to photographs, or at least under § 72 UrhG as photographs or products created similarly to photographs. KussatzTrade holds the exclusive usage rights for them.

11.2 Publications, reproductions, and distributions based on the protected intellectual property are only permitted with the written consent of KussatzTrade.

12. DISPUTE RESOLUTION

The EU Commission has created an online platform for dispute resolution. This platform serves as a contact point for the out-of-court resolution of disputes regarding contractual obligations arising from online purchase agreements. Further information is available at the following link: http://ec.europa.eu/consumers/odr.

We are willing or, in accordance with § 36 VSBG (Consumer Dispute Resolution Act), obliged to participate in a dispute resolution procedure before a consumer arbitration board in order to settle disputes with consumers.

The responsible consumer arbitration board is:

We will participate in a dispute resolution procedure before this arbitration board to settle the disputes mentioned.

13. SEVERABILITY CLAUSE

If individual provisions of the contract, including these regulations, are or become wholly or partially invalid, or if the contract contains an unforeseen gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. In place of the invalid or missing provisions, the respective statutory regulations shall apply.
